Is there any penalty (SEO) if I don’t use a ‘proper’ Sparkle Nav menu, but make my own Nav menu using buttons?

Wouldn’t think so. Penalty comes from either doing something wrong on a technical level, or doing something wrong on a content level.
Content is up to you, if you create content that Google things is spam, you are penalized. This is generally very easy to avoid, if you aren’t intentionally trying to game the system. Just use honest content (which can include marketing hyperbole!).
On a technical level there really isn’t anything you can do wrong by using plain Sparkle features. Everything that is navigation ends up being a link to Google’s bot, and works fine.
